Schindler Elevator Ltd., Switzerland ("Schindler Elevator") developed the publicly available Schindler Ahead ActionBoard app for mobile devices (the "Schindler Ahead ActionBoard App").
The processing of personal data, if any, by Schindler Elevator and/or its affiliates (together, "Schindler") in connection with the use of the Schindler Ahead ActionBoard App by its users takes place in Schindler’s capacity as data processor(s) only. The owner or manager of the respective building acts as data controller. Please refer to the building owner or manager and its privacy notice for information or general queries relating to data processing in connection with the Schindler Ahead ActionBoard App.
Schindler Elevator Ltd., Switzerland ("Schindler Elevator") developed the publicly available Schindler ElevateMe app for mobile devices (the "Schindler ElevateMe App"). The Schindler ElevateMe App may enable its users ("Users") to place elevator destination calls without touching elevator operating panels.
The Schindler ElevateMe App does not collect and process any personal data of its Users. Users do not have to provide any personal data (e.g. name, email address) to Schindler Elevator. User location is neither tracked nor stored and no unique identifier or suchlike is registered on their mobile devices.
Schindler Elevator Ltd., Switzerland ("Schindler Elevator") developed the publicly available myPORT Public app for mobile devices (the "myPORT Public App"). The myPORT Public App may enable its users ("Users") to place elevator destination calls without touching elevator operating panels.
The myPORT Public App does not collect and process any personal data of its Users. Users do not have to provide any personal data (e.g. name, email address) to Schindler Elevator. User location is neither tracked nor stored and no unique identifier or suchlike is registered on their mobile devices.
The myPORT solution ("myPORT") is a technology of Schindler Elevator Ltd., Switzerland ("Schindler Elevator", "we" or "us"). Schindler Elevator and its affiliates are herein collectively referred to as "Schindler".
MyPORT is designed for your access to and use of elevators in buildings that are equipped with the myPORT technology of Schindler. myPORT is offered as an app or directly over the internet via a browser. MyPORT possesses two different functionalities: A public functionality, only available in the app version, intended for use by guests of the building that is active without being signed-in ("Public Functionality"), and a signed-in functionality that requires a sign-in, via an internet browser or the app version ("Signed-In Functionality"). Both functionalities basically simulate the elevator operating panel, so that you can place elevator destination calls with MyPORT without touching the physical panels. The legal notice explains in more detail how MyPORT works and it also it also includes information on the additional features of the Signed-In Functionality that the Public Functionality does not possess.
MyPORT does not track your location, but it uses location service features to detect when you are near a PORT touchpoint (terminal, door, elevator) so that you can easily order or open it.
1. Public Functionality
The Public Functionality of myPORT for use by guests does not collect and process any of your personal data and you do not have to provide any personal data (e.g., name, email address) to Schindler Elevator. Your location is neither tracked nor stored and no unique identifier or alike is stored on your mobile devices.
2. Signed-In Functionality
2.1 Data Processed, Controller and Processor
When you sign up for the Signed-In Functionality (over the internet or after the installation of the myPORT app), we verify your identity with a two-factor authentication. You must always provide your email address. Depending on the authentication method you select, you may also have provide your mobile phone number. With respect to this data, Schindler Elevator acts as the data controller.
With respect to all other personal data potentially processed in connection with your use of the Signed-In Functionality of myPORT (e.g., to what floors you have access, history of your elevator trips etc.), the myPORT contract partner of Schindler of the respective building (your employer, your landlord etc.) is the data controller, whereas the contracting Schindler entity acts as the data processor only.
This Privacy Notice only refers to the data processing by Schinder Elevator in its capacity as a data controller. For all other data processing in connection with myPORT, please refer to the respective data controller (your employer, your landlord etc.).

2.3. Purpose of Data Processing and Legal Basis
Schindler Elevator processes your personal data for the purposes of operating the App. This may include a two-factor authentication process during the sign-up process.
We process your personal data based on the legitimate interests pursued by us to enable our partners to use the myPORT technology in their buildings.
2.4. How long do we retain your Personal Data?
We process and retain your personal data as long as required for the purposes for which we collected it and, if applicable, for compliance with legal obligations or other legitimate business purposes. As soon as your personal data are no longer required for these purposes, it will be deleted or anonymized, to the extent possible.
2.5. Transfer of Personal Data to Other Parties (In-/Outside of the EEA)
We may, pursuant to valid legal process, such as a search warrant, subpoena, or court/governmental order, allow access to your personal data provided to Schindler, to comply with such process and to protect our rights and property. If warranted, we may also allow access to this information in special emergencies where physical safety is at risk.
Schindler Elevator moreover reserves the right to disclose your personal data in connection with a merger, acquisition, bankruptcy or sale of all or substantially all of its or of Schindler’s assets.
Your personal data may be transferred to other Schindler entities, as well as to any third parties to whom the relevant Schindler entity subcontracts all or part of this processing. This may for instance include hosting providers, technical support, and any other relevant roles. Such third parties will process such personal data only for the purposes listed in this Privacy Notice and agree to treat it in accordance with it. They may only process your personal data in the same way as Schindler Elevator is permitted to process it.
As Schindler is a global and worldwide acting group, your personal data may be transferred to to any of the countries where we have affiliates (available on the webpage of the Schindler Group, currently under https://group.schindler.com/en/system/worldwide.html). This includes countries that may provide for a lower level of data protection than the country from where you reside. In the event of transfer of personal data to a country outside of the European Economic Area (EEA) or Switzerland, Schindler systematically ensures the application of an adequate level of protection of such personal data by approved means (e.g., putting in place standard contractual clauses on the processing of personal data, in accordance with the EU Commission model clauses).
Except as otherwise set forth in this Privacy Notice, we do not sell, trade, license or rent or otherwise share your personal data with any third parties outside of Schindler.
2.6 Your Rights
Subject to applicable law, you may have some or all of the following rights in respect of your personal data. You can exercise these rights by submitting your request to dataprivacy@schindler.com.
You may have the right to obtain confirmation of whether Schindler Elevator processes personal data in relation to you and, if so, gain access to a copy thereof. If you require additional copies, we may need to charge a reasonable fee. For certain kinds of data, you may also have a right to data portability. You may have the possibility to rectify or obtain the erasure of your personal data, provided that the applicable legal requirements are met. The right to erasure is subject to various exceptions, notably as regards personal data whose processing is necessary to support litigation or for compliance with statutory retention requirements. You may have the right to object to the processing of your personal data and we will respect this right if we are relying on our own or someone else's legitimate interests to process your personal data, except if we can demonstrate compelling legal grounds for the processing of your personal data. In relation to the processing of your personal data for direct marketing purposes, you may have the right to object at any time thereto. Where any processing is based on consent, you may have the right to withdraw such consent at any time (without this affecting the processing prior to the consent withdrawal). All of our employees, partners, consultants, workers and data processors (i.e., those who process your personal data on our behalf) are obliged to respect the confidentiality of such data.

Welcome to the MySchindler mobile App ("MySchindler App"). We are committed to protecting and respecting your privacy. This notice ("Privacy Notice") explains how we collect, use, and protect your personal data when you use the MySchindler App.
The MySchindler App is an app designed for the passengers of elevators manufactured and/or maintained by Schindler. The app serves as a user interface to elevator control/destination call and transit management systems and services ("External Services") that are provided to a building owner or manager ("Schindler Customer") under an agreement with Schindler Elevator Ltd. or one of its affiliates (collectively "Schindler"). A prerequisite for a working access to the External Services through the MySchindler App is a valid agreement between Schindler and the Schindler Customer covering such External Services for the relevant elevator(s). Any provision of External Services by Schindler is agreed solely under its agreement with the Schindler Customer. Any right to use External Services for the relevant elevator(s) is granted to you by the Schindler Customer. Only some elevators are compatible with the MySchindler App and not all the functionalities of the External Services available through the app may be supported by the elevator you use. Further, some of the functionalities require that your mobile device is connected to the internet.
The MySchindler App supports two "modes": Firstly, a mode where no Sign-In is required, which only supports some basic features designed for guests of the respective building ("Guest-Mode"). Secondly, a mode where Sign-In and thus a user account is needed. This mode is designed for tenants of the respective building, and it possesses more functionalities than the Guest-Mode ("Tenant-Mode"). Please note that after you have created a user account, you can only use the MySchindler App in the Tenant-Mode once you have been actively invited by a building owner or manager to join a building.
The data controller of the MySchindler App is Schindler Elevator Ltd., Zugerstrasse 13, 6030 Ebikon, Switzerland (herein "we" or "us").
We collect and process the following personal data, which you submit during the sign-up process to enable the Tenant-Mode:
In both modes (Guest-Mode and Tenant-Mode), the MySchindler App relies on the "Location Services" of your mobile device. You may get an automatic notice from the operating system of your mobile device about this. However, we only use the Location Services to check that you are nearby an elevator; we do not track or process your location data. After the installation of the app, you will be asked for permission to enable Location Service and the use of Bluetooth® wireless technology. If you do not enable these features, the app will not work.
Also, the MySchindler App processes diagnostic data in both modes (Guest-Mode and Tenant-Mode) that are not directly related to an individual but contain a unique identifier. We are unable to assign this data to an individual.
We collect and process the personal data you submit during the sign-up process for the creation and management of your account.
The diagnostic data collected are processed to keep the app secure, up-to-date and to safeguard its optimal performance.
We process your personal data based on our legitimate interest to offer the MySchindler App to Schindler Customers (facility managers, building owners) as an additional, value-add feature to the Schindler service offering, which is also beneficial to you as a tenant or guest of a building.
We may share your personal data with the following data recipients:
Your personal data may be transferred to other countries. This includes countries that may provide a lower level of data protection than the country from where you have submitted your data. In the event of a transfer of personal data to a country outside of the European Economic Area (EEA), the UK or Switzerland, we ensure an adequate level of protection of such personal data by suitable safeguards (e.g., by putting in place the Standard Contractual Clauses of the EU Commission with the data recipient in the third country; a copy of these clauses can be requested by email at dataprivacy@schindler.com).
We will retain your personal data for as long as necessary to fulfil the purposes for which it was collected, including any legal, accounting, or reporting requirements. When your data is no longer required, we will securely delete or anonymize it.
